These Terms of Service govern your access to and use of vaemish.com and your purchase of products sold under the VAEMISH brand.

VAEMISH is operated by HEMSHE NAVIORE LIFESTYLE LLP, GSTIN 09AATFH8814Q1Z9, with its registered office at Ground Floor, Villa A-18, Kamakhya Villas, Greater Noida West, Chipiyana Main Road, Shaberi Village, Greater Noida, Gautam Buddha Nagar, Uttar Pradesh – 201009, India.

By accessing the website, creating an account, placing an order or using our services, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund, Replacement & Cancellation Policy.

  1. Eligibility

You must be legally capable of entering into a binding contract under applicable Indian law to place an order.

If you use this website on behalf of another person or organization, you confirm that you have authority to bind that person or organization to these Terms.

  1. Website Use

You agree not to:

• Use the website for unlawful, fraudulent or unauthorized purposes
• Attempt to interfere with the security or operation of the website
• Introduce viruses, malicious code or harmful technology
• Scrape, copy or commercially exploit website content without permission
• Impersonate another person or provide false information
• Place fraudulent orders or misuse promotional offers

VAEMISH may restrict or terminate access where misuse, fraud or unlawful activity is reasonably suspected.

  1. Product Information

We make reasonable efforts to display product names, descriptions, fragrance notes, sizes, concentration, pricing and images accurately.

Screen settings, lighting and production variations may result in minor visual differences. Fragrance perception, longevity and projection may vary according to skin chemistry, application, storage, climate and individual sensitivity.

Such personal or environmental variations do not by themselves constitute a defect.

  1. Pricing and Taxes

Unless clearly stated otherwise, product prices displayed on the website are in Indian Rupees and include applicable GST.

Shipping charges, where applicable, are calculated separately according to the delivery location and displayed during checkout.

We reserve the right to correct accidental pricing, typographical or product-information errors. If an error affects an order already placed, we will contact the customer before fulfilment or cancel and refund the affected order.

  1. Orders and Acceptance

An order confirmation acknowledges receipt of your order but does not guarantee acceptance or dispatch.

An order is accepted when it has been verified and dispatched.

VAEMISH may refuse or cancel an order because of product unavailability, inaccurate information, payment failure, suspected fraud, delivery restrictions or circumstances beyond our reasonable control.

If VAEMISH cancels a prepaid order before dispatch, the amount received for the cancelled order will be refunded to the original payment method.

  1. Payments

Available payment methods are displayed during checkout and may include prepaid payment methods and Cash on Delivery for eligible PIN codes.

You confirm that you are authorized to use the selected payment method and that all billing and delivery information supplied is accurate.

Transactions may be processed by third-party payment providers and may also be subject to their terms and privacy practices.

  1. Shipping and Delivery

Orders are generally processed within 3 working days. Delivery time depends on the destination and courier partner.

Shipping charges are based on the delivery location. Cash on Delivery is available only for eligible PIN codes.

Customers are responsible for providing a complete and accurate shipping address and reachable contact number.

Detailed delivery, tracking, courier-delay, lost-shipment and return-to-origin provisions are set out in our Shipping Policy.

  1. Cancellations

Customers may request order cancellation before dispatch.

Orders cannot be cancelled after dispatch.

Submitting a cancellation request does not guarantee cancellation if processing or dispatch has already occurred.

VAEMISH may cancel suspicious, fraudulent, unavailable-product or unverifiable orders. Approved prepaid cancellations will be refunded to the original payment method.

  1. Returns, Replacements and Refunds

VAEMISH does not accept returns or exchanges for change of mind, fragrance preference or dislike, including for unopened or sealed products.

Discovery sets, samples and complimentary gifts are non-returnable and non-refundable except where required by applicable law.

Damaged, leaking, defective, incorrect or materially misdescribed products must be reported within 3 calendar days of delivery with the information and evidence specified in our Refund, Replacement & Cancellation Policy.

An approved claim will ordinarily be resolved through replacement. If replacement is unavailable, a full refund for the affected product will be issued to the original payment method.

Nothing in these Terms limits consumer remedies that cannot lawfully be excluded.

  1. Complimentary Gifts and Promotions

Complimentary gifts, discount codes and promotional benefits:

• Have no independent cash value
• Cannot be exchanged or refunded separately
• May be subject to eligibility conditions
• May be withdrawn or changed before an order is placed

If an approved return includes an order supplied with a complimentary gift, the gift must also be returned unless VAEMISH confirms otherwise.

  1. Intellectual Property

All website content—including VAEMISH branding, logos, product names, photographs, graphics, designs, text, videos, layouts and software—is owned by or licensed to HEMSHE NAVIORE LIFESTYLE LLP and is protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes. No content may be reproduced, modified, distributed, republished or commercially exploited without prior written permission.

  1. Reviews and User Content

If you submit a review, photograph, video, testimonial or other content, you confirm that:

• The content is truthful and based on your genuine experience
• You own the content or have permission to submit it
• It does not violate any law or third-party right
• It is not defamatory, abusive, misleading or harmful

You grant VAEMISH a non-exclusive, worldwide, royalty-free licence to use, reproduce and display submitted content for website, customer-service and promotional purposes, unless otherwise agreed in writing.

  1. Third-Party Services and Links

The website may use or link to services operated by payment providers, courier companies, analytics providers or other third parties.

VAEMISH is not responsible for third-party websites or services outside its reasonable control. Use of those services may be governed by separate terms and privacy policies.

  1. Availability and Website Operation

We may modify, suspend or discontinue any product, feature, promotion or part of the website without prior notice, subject to obligations relating to already accepted orders.

We do not guarantee that the website will always operate without interruptions or technical errors, but we will make reasonable efforts to maintain its availability and security.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, VAEMISH and HEMSHE NAVIORE LIFESTYLE LLP will not be liable for indirect, incidental or consequential losses arising from website use, delivery delays outside our reasonable control or misuse of a product.

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded, including applicable consumer rights.

  1. Indemnification

You agree to indemnify HEMSHE NAVIORE LIFESTYLE LLP against reasonable losses or claims arising from your unlawful use of the website, violation of these Terms or infringement of another person’s rights.

This clause applies only to the extent permitted by applicable law.

  1. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum lawful extent or removed, while the remaining provisions will continue in effect.

  1. Changes to These Terms

We may update these Terms to reflect changes in our products, services, operations or legal requirements.

The updated version will be posted on the website with a revised “Last updated” date. Changes will not retrospectively reduce rights relating to an order already placed, unless required by law.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer-protection law and the jurisdiction of competent consumer commissions or authorities, disputes will be subject to the courts having jurisdiction in Gautam Buddha Nagar, Uttar Pradesh.
